1. Identity and Scope
1.1 These general terms and conditions apply to all orders and agreements entered into through the Port2Port NV online store, www.port2port.be.

1.3 By placing an order, the customer declares that they have read and agree to these terms and conditions.
1.4 Consumers are always entitled to their mandatory statutory consumer rights. The provisions in these terms and conditions do not affect these rights.
2. Orders and Age
2.1 Alcoholic beverages are sold exclusively to individuals 18 years of age or older.
2.2 By ordering alcoholic beverages, the customer certifies that he or she is at least 18 years old.
2.3 Port2Port reserves the right to conduct an age verification when required by law or when reasonably necessary.
2.4 An order is subject to the availability of the ordered products and successful payment.
2.5 In the rare event that an ordered product is unavailable, the customer will be notified as soon as possible. If necessary, the amount paid for the unavailable product will be refunded.
3. Product Information and Prices
3.1 The prices displayed in the online store are in euros and include applicable VAT and, where applicable, excise taxes, unless expressly stated otherwise.
3.2 The price displayed during the ordering process at the time the order is placed applies to that order.
3.3 Port2Port may change prices for future orders.
3.4 Any additional shipping costs will be displayed before the order is finalized.
3.5 For older wines and port wines, the condition of the label, the capsule, the packaging, the fill level, and other external characteristics may vary depending on the age and storage conditions of the bottle. Product images are intended to provide as accurate a representation as possible. If the image refers to the actual bottle being offered, this may be noted in the product description.
4. Payment
4.1 The customer can pay using the payment methods offered during checkout in the online store.
4.2 Port2Port does not charge any separate fees for the use of a payment method, unless this is permitted by law and is expressly stated before the order is placed.
4.3 If the payment is not completed successfully, the order cannot be processed.
4.4 Port2Port may delay shipment until full payment has been received.
5. Shipping and Shipping Costs
5.1 Port2Port ships orders to the destinations supported by the online store at the time of ordering. Legal, tax, customs, or shipping restrictions may apply to certain countries, products, or customer types.
5.2 Orders are carefully packaged, with special attention paid to the safe transport of spirits, wine, and other fragile products.
5.3 The available shipping methods and current shipping costs are displayed during checkout. Shipping costs may depend on factors such as the destination country, the size or weight of the order, and the selected shipping method.
5.4 Depending on the destination and the value of the order, free shipping may apply. The current terms and conditions for free shipping are automatically applied and displayed during checkout.
5.5 Port2Port ships to various European countries and, where possible, also to destinations outside the European Union. Special rules regarding VAT, excise taxes, import duties, customs formalities, or other levies may apply to international shipments. The applicable procedures depend on the destination and the applicable laws.
5.6 If a destination is not available during checkout, the customer can contact Port2Port to inquire whether shipping to that destination is possible.
5.7 Orders can also be picked up free of charge at Port2Port in Brecht. Pickup is available only by prior appointment.
6. Delivery and Risk
6.1 Unless a different delivery period has been agreed upon, orders for consumers will be delivered no later than the statutory deadline.
6.2 If a delay is identified, Port2Port will notify the customer as soon as possible.
6.3 In the case of sales to consumers where the carrier is provided or selected by Port2Port, the risk of loss or damage during transport remains with Port2Port until the customer or a third party designated by the customer—who is not the carrier—has physically taken possession of the goods.
6.4 If the consumer chooses a carrier not offered by Port2Port, the risk passes to the consumer as soon as Port2Port has handed the goods over to that carrier.
6.5 The foregoing provisions do not affect the consumer’s statutory rights.
7. Damage During Delivery
7.1 The customer is requested to report any visible damage to an order to Port2Port as soon as possible after receipt via [email protected].
7.2 In order to assess the damage and, if necessary, open a claim with the carrier, Port2Port may request clear photos of the damaged bottle or goods, the inner and outer packaging, and the shipping label.
7.3 The customer is therefore asked not to discard damaged goods and their packaging until Port2Port has had a chance to review the report.
7.4 This practical reporting procedure does not limit consumers’ legal rights.
8. Right of Withdrawal for Consumers
8.1 In the case of a distance contract, a consumer generally has a statutory cancellation period of 14 calendar days, unless a statutory exception applies.
8.2 For goods, the withdrawal period generally begins on the day after the consumer—or a third party designated by the consumer who is not the carrier—has physically taken possession of the goods.
8.3 The consumer is not required to provide a reason for exercising the right of withdrawal.
8.4 The consumer may notify Port2Port of his decision to cancel by means of an unambiguous statement or by using the Port2Port's online cancellation form.
8.5 After cancellation, the goods must be returned within 14 days at the latest, in accordance with the applicable laws.
8.6 The direct costs of returning the goods in the event of a standard cancellation are the responsibility of the consumer.
8.7 In the event of a valid and complete cancellation, Port2Port will refund the payments received in accordance with the applicable laws, including the standard shipping costs for the original delivery. Additional costs resulting from the consumer’s choice of a more expensive delivery method than the standard delivery offered by Port2Port do not have to be refunded.
8.8 Port2Port may delay the refund until the goods have been returned or until the consumer provides proof that the goods have been returned, whichever occurs first.
8.9 The consumer is liable only for any decrease in the value of the goods resulting from actions that go beyond what is necessary to determine the nature, characteristics, and functioning of the goods.
8.10 The right of withdrawal does not apply in cases where the law provides for an exception, including certain goods manufactured according to the consumer’s specifications or clearly personalized goods, and other products or services excluded by law.
9. Statutory Warranty and Conformity
9.1 Consumers are entitled to the statutory warranty and rights of conformity as provided by applicable Belgian law.
9.2 In principle, consumer goods are covered by a two-year statutory warranty period beginning on the date of delivery.
9.3 If a consumer discovers a defect, it must be reported to Port2Port as soon as possible and no later than two months after it is discovered.
9.4 A report can be submitted via [email protected]. Port2Port may request information, photos, and a proof of purchase that are reasonably necessary to assess the reported issue.
9.5 These terms and conditions do not limit consumers' statutory warranty rights.
10. Liability and Product Features
10.1 Port2Port takes due care with the information, images, prices, and availability displayed in the online store.
10.2 Obvious errors, material errors, or technical errors may be corrected, provided that such corrections are made in a manner that respects the customer’s applicable legal rights.
10.3 Older or aged wines and port wines may exhibit natural variations in, among other things, the label, capsule, cork, fill level, color, and physical condition. Such characteristics are evaluated taking into account the age and nature of the product.
10.4 Nothing in these terms and conditions excludes or limits liability to the extent that such exclusion or limitation is not permitted under applicable law.
11. International Orders
11.1 International orders are only possible for destinations and customer types for which Port2Port is currently able to offer sales and delivery.
11.2 Alcohol laws, excise tax rules, VAT rules, customs formalities, and shipping terms vary by country. As a result, Port2Port may refuse or restrict certain products, orders, or customer types for specific destinations when necessary to comply with applicable regulations.
11.3 A destination that is not available during checkout cannot be considered an available delivery destination without prior confirmation from Port2Port.

12.2 Port2Port strives to resolve complaints as quickly as possible and in consultation with the customer.
12.3 If a dispute between a consumer and Port2Port cannot be resolved directly, the consumer may turn to the competent out-of-court dispute resolution body, including the Consumer Ombudsman Service, to the extent that it has jurisdiction.
13. Business Customers
13.1 If the customer is acting for purposes related to his trade, business, craft, or profession, he is considered a business customer for the purposes of this agreement.
13.2 The statutory right of withdrawal for consumers does not apply to business-to-business purchases.
13.3 Different delivery, payment, and shipping terms may be agreed upon for business customers.
13.4 To the extent permitted by law, the delivered goods remain the property of Port2Port until all amounts due have been paid in full.
13.5 In certain countries, business-to-business sales of alcohol may not be offered, or may be offered only under additional conditions, due to local tax, excise, registration, or other legal requirements.
14. Governing Law and Disputes
14.1 Agreements with Port2Port are governed by Belgian law, without prejudice to the mandatory consumer protection rights to which a consumer is entitled under applicable law.
14.2 Disputes shall be submitted to the court having jurisdiction under the applicable legal provisions.
14.3 For consumers, this provision does not affect mandatory rules regarding jurisdiction and consumer protection.
15. Nullity and Amendments
15.1 If any provision of these general terms and conditions is found to be invalid, void, or unenforceable, in whole or in part, this shall not affect the validity of the remaining provisions.
15.2 Port2Port may amend these terms and conditions for future orders. The terms and conditions in effect at the time an order was placed apply to that order.
16. Privacy
16.1 Personal data is processed in accordance with applicable privacy laws and Port2Port’s Privacy Statement.
16.2 Personal data will not be automatically deleted after an order has been delivered if Port2Port is required to retain such data due to legal, tax, accounting, or other legitimate obligations or purposes.

17. Responsible alcohol consumption
17.1 Port2Port sells alcoholic beverages exclusively to individuals 18 years of age or older.
17.2 Port2Port encourages responsible alcohol consumption.
